Do companies have a choice? Do companies "do dual agency"?

Companies set their policies and procedures or they are dictated to them by their franchise. All companies are not alike and not all franchises are alike. Of course, companies have to abide by federal law first; then state law; then local law; then their company policy.
Dual agency may mean that individual agents will "double dip"; in other words, get both the buyer's and seller's commission.
The problem with this is that even though an agent will try hard to be fair, information WILL slip that will give the other party an advantage in the positioning in the deal. Things will just happen or the agent will be human and favor one party over the other whether they mean to or not, it is just a fact of life.
Tennessee allows dual agency but there are other states who do not.
